Report of the meeting of the Parish Council of Castle Hedingham held on Wednesday, 17th January 2007 issued by the Clerk

Community Speed Watch – The Parish Council noted the excellent press coverage of Castle Hedingham Parish Council’s involvement in this scheme.  It was noted that they are monitoring speed twice a week.

Planning Comments

The Parish Council had no objections to the following applications - Application 06/02206/FUL – Erection of first floor side extension - 2 Sheepcot Cottages, Sheepcot Road, Castle Hedingham; Application 06/02287/FUL – Erection of two storey side/rear extension and front entrance porch- 24 Crouch Green, Castle Hedingham; Application 06/02396/FUL & 06/02397/LBC– Erection of two storey side extension - Wood Hall, 67 Nunnery Street, Castle Hedingham and Application 07/00017/TPOCON – carry out works to trees - 3A Crown Street, Castle Hedingham.

Application 06/02336/FUL – Erection of single storey side extension and detached double garage -Harveys Pottery Lane, Castle Hedingham  -  The Parish Council would encourage and support the use of solar panels and would trust that they would be acceptable in planning terms.  No objections.

Application 06/02310/FUL – erection of detached one and a half storey bungalow - Binghams, Pottery Lane, Castle Hedingham – The Parish Council has no objections to this application.  We would point out that although the applicant mentions that the views of the Parish Council and Village Design Statement Group have been taken into consideration there has been no formal consultation with either of these bodies and any comments sought can only have been from individuals and as such were personal views only.

Planning Appeal - 06/01373/COU -  Change of use of land for the temporary stationing of 2 No. portakabin buildings - Land to the rear of Memories, Crouch Green, Castle Hedingham - The Parish Council supports the location of the portakabin and therefore supports this appeal as it is imperative that we keep the doctors' surgery in the village.

Application 06/02381/FUL – Demolition of existing garage and erection of new pitched roof double garage – amendments to existing planning approvals 06/01084/FUL & 06/01526/FUL - 8 Queen St, Castle Hedingham The Parish Council is concerned about the loss of light to the neighbouring listed building.  The Parish Council would also like to be assured that the structure cannot be used as a separate dwelling and would like a condition placed upon the application to this effect. This comment had been submitted on 29th December due to Braintree District Council time constraints. Councillors discussed this matter in detail and it was again noted that it may be difficult to be successful in raising objections to the application as a previous applicant had been granted with no objection from any parties. However it was agreed that the following comments also be submitted to Braintree District Council:

  1. Following concerns raised by parishioners regarding the inaccuracies of the footprint in the original planning application the Parish Council  would like clarification as to whether there was a site visit by Braintree District Council Planning Officers or whether approval was given based on the on the drawing provided alone.
  2. The inaccuracies are such that the extension would have much more impact that the original plans showed and the Parish Council request a resurvey of the site.
  3. The Parish Council request that the slab level is reduced to reduce the overall height of the roof and therefore reduce the impact on the neighbouring property.
  4. The Parish Council have already requested that a condition be placed that the property cannot be used as a separate dwelling, they also request that a condition be placed that prohibits its commercial use.

It was agreed that a copy of this comment be sent to the parishioners who raised concerns regarding this application.

Application  06/02575/FUL – erection on 2 no. semi-detached two storey dwellings with carport and parking space - Land Adjoining 16 Crown Street, Castle Hedingham – Councillors discussed this application in detail and agreed that the comments submitted to previous applications on this site still apply and indeed Councillors agreed this application was even less suitable than those submitted previously.  It was therefore agreed that the following comment be submitted to Braintree District Council:

The Parish Council continue to have concerns about this application for the following reasons:

  1. This further application is for an even higher density of houses which are even larger, more imposing and will have a greater impact on the street scene and neighbouring properties than previous applications. Two large houses with garages/car ports on this relatively small site represents a too dense development. One house would be acceptable or possibly two smaller ones.
  2. The site is on the edge of the outer bailey of the castle and we have concerns on the proposed development's effects on neighbouring properties. In particular the structural stability of both 8,Castle Close and 13, Pye Corner could be affected when the site level is lowered to road level as proposed. No 13 is only 2.0m from the face of the development and 1.Om higher, no 8 is 7.5m from the proposed garages and 2.0m higher. With the deeper digging of foundations this could lead to slip. We ask that a detailed geo-technical survey be carried out as a pre-requisite to development with particular consideration given to including boundary retaining walls.
  3. The Parish Council object to the chosen materials, particularly the garages/car ports.  The roofs to these structures will be vast and dominating especially from Castle Close. The use of slate and weatherboarding will exaggerate this and is unacceptable in this conservation area. All materials must be in keeping with the surroundings, clay tiles and brickwork with scaled down roof proportions would be acceptable.
  4. The historical and archaeological significance of this site on the castle's old outer walls/defences mean that we would ask for an archaeological survey/excavation to be carried out as a precursor to any development.
  5. We have concerns about the safety of the site during construction. The  site abuts a difficult junction for vehicles coming into or out of Crown St and the area can get ,congested. Construction traffic will exaggerate this problem.
  6. The Parish Council is also concerned that the drainage and soak away shown are insufficient.

Application 06/02504/FUL – Erection of extension and remodelling to existing dwelling - 3A Crown Street, Castle Hedingham – the Parish Council objects to this application and notes that the site implies ownership of a vast site much of which the Parish Council understand is owned by others.  The term remodelling is misleading  the intention is to turn a small five room bungalow into a two storey thirteen room house.  The location is behind old listed buildings and the brash style proposed is totally unsympathetic in style, size and character to the area.  Previous approval was given for a more modest extension, to which the Parish Council had no objection, the present proposal far exceeds this.  The proposed use of black weather boarding is not clearly defined in area and is not in keeping with the surrounding area.  In terms of planning policy it would now seem to be contrary to ”the siting , bulk, form and materials of the extension should be compatible with the original dwelling” and it is now a large development in the flood plain.

Application 06/02584/LBC – Reinstatement of dwelling house following fire, complete replacement of coach house, minor amendments to main barn- Rushley Green Barn, Rushley Green, Castle Hedingham – No objections – seems sympathetic and well designed.

Other Planning Matters

Planning Appeal – Application Number 05/01514/OUT - Land rear of 118-132 Nunnery Street, Castle Hedingham – It was noted that the applicant had lost their appeal.

Abuse of Weight Restrictions in Braintree District - Essex County Council Trading Standards is keen to hear from Parish Councils and local residents about the suspected abuse of weight restrictions on local roads in the Braintree district by heavy commercial vehicles. They have provided a log sheet for local residents to complete and return to them. Please contact the Clerk – Mrs Helena Carter 0178 461149 after 6.00 pm Monday – Friday if you would like a form.

Footpaths – Mr Bird has advised the Clerk of various items that need to be ordered for repairs to the parish’s footpaths.  These have been ordered through the Essex County Council’s P3 scheme. Mr Bird had also informed the Clerk that Essex County Council will shortly start works to the footpath adjacent to the wood yard.  Mrs Kendal had written to the Clerk expressing concern regarding this footpath and will be advised that Essex County Council  are to do improvement works.  Mr Bird will be asked to look at the two stiles in Scotch Pasture which are in need of attention
